When a work of art is created you have copyrights in that work immediately. An example, would be taking a picture, as soon as that picture is visible you have copyrights in that photo, however, a copyright is only as good as its ability to be enforced. That is why it is important to register your works with the Library of Congress, because it increases your ability to enforce your rights. What advantage does Copyright Registration give you, it allows you to enforce your rights and have your attorney’s fees paid. Also in infringement cases you need to have damages in order to collect. By Registering your work you have the benefit of presumed statutory damages. Registration of your work to attain maximum benefit is time sensitive you have a few months or a narrow window at which point the benefits of registration are nullified.
